1. Agreement to these terms
These Terms of Use (“Terms”) form an agreement between you and the operator of Sai VPN (“Sai VPN,” “we,” “us,” or “our”). They apply to the Sai VPN Android app, the website at sai-vpn.com, the VPN service, and related backend features (collectively, the “Service”).
By installing, purchasing, accessing, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
2. Eligibility
You must be legally capable of entering into this agreement. If you are under the age of legal majority where you live, a parent or legal guardian must review and accept these Terms for you. The Service is not directed to children under 13, or a higher minimum age where local law requires it.
3. The Service and VPN permission
Sai VPN provides access to available VPN endpoints and related connection tools. To create a device-level VPN tunnel, Android will ask you to approve the system VPN permission. You may decline, but the VPN function will not work without it.
Server availability, speed, latency, protocols, locations, and compatibility may change. Actual performance depends on factors outside our control, including your device, internet provider, local network, location, congestion, and third-party infrastructure. We do not guarantee that any particular server, location, website, app, or content will always be reachable.
4. Limited license
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the app on devices you own or control for personal, lawful use. No ownership rights are transferred to you.
You may not:
- copy, sell, rent, sublicense, redistribute, or commercially exploit the Service except where law expressly permits;
- reverse engineer, decompile, modify, or attempt to derive source code except to the limited extent a restriction is prohibited by law;
- bypass access controls, subscription checks, rate limits, security features, or technical restrictions;
- use Sai VPN branding, software, servers, or content to create a competing or misleading service.
5. Acceptable use
You must not use, or help anyone use, the Service to:
- violate applicable law, regulations, court orders, or the rights of others;
- distribute malware, conduct phishing, send spam, or facilitate fraud;
- gain unauthorized access to accounts, devices, networks, or data;
- attack, scan, overload, disrupt, or interfere with systems or services;
- infringe intellectual property, privacy, publicity, or other legal rights;
- exploit, harm, or endanger children or distribute unlawful abusive content;
- resell, share at scale, automate, or otherwise use access in a way that harms other users or our infrastructure;
- misrepresent your identity or use the Service to conceal responsibility for prohibited conduct.
You are responsible for your conduct and for confirming that your use of a VPN is lawful where you are located. We may investigate suspected abuse and restrict or suspend access when reasonably necessary to protect users, providers, or the Service, or to comply with law.
6. Anonymous installation access
The app may create anonymous installation and customer identifiers and store credentials on your device to access the backend. You must not share, extract, publish, or misuse access tokens, installation secrets, server configurations, or other protected service data. You are responsible for keeping your device secure.
7. Free service and advertising
Free access may be supported by third-party advertising and may include usage limits, waiting periods, fewer locations, or other reasonable restrictions. Ads may be selected and measured by CAS.AI and its mediation partners according to your region, device settings, and consent choices. Advertising practices are further described in our Privacy Policy.
8. VIP subscriptions
Purchase and benefits
VIP plans are offered through Google Play. While a verified subscription is active, VIP may include access to premium servers and removal of in-app ads. The exact product, price, currency, billing period, introductory offer, trial, tax, and renewal terms shown by Google Play before confirmation are the terms of your purchase.
Automatic renewal
A recurring subscription automatically renews and Google Play charges the payment method associated with your account at the start of each billing period unless you cancel before renewal. Uninstalling Sai VPN does not cancel a subscription.
Manage or cancel
You can manage or cancel renewal from Google Play Subscriptions. Cancellation normally takes effect at the end of the paid billing period, so VIP access generally continues until then. Rules may differ for prepaid plans, payment plans, or where applicable law requires otherwise.
Restoration and synchronization
The app uses Google Play and RevenueCat to validate, restore, and synchronize VIP status. Use the same Google Play account and the in-app restore option after a reinstall or device change. Temporary delays, account mismatch, store outages, or connectivity problems may postpone entitlement synchronization.
Refunds
Purchases are processed by Google Play. Refund eligibility and processing are governed by Google Play policies and applicable consumer law. You may request a refund through Google Play or contact us for help. Nothing in these Terms limits a refund or remedy that applicable law requires.
Changes to plans
We may change future plan availability, benefits, or pricing. Any price change to an existing recurring subscription will be handled with the notice or consent required by Google Play and applicable law.
9. Third-party services and content
The Service depends on third parties such as Google Play, RevenueCat, Firebase, CAS.AI, advertising networks, hosting providers, and network infrastructure. Their products, content, availability, and data practices are governed by their own terms and policies. We are not responsible for third-party services to the extent permitted by law, but we remain responsible for obligations that cannot lawfully be excluded.
10. Intellectual property
Sai VPN and its licensors retain all rights in the Service, including software, visual design, names, logos, text, and other materials. Open-source components are licensed under their respective licenses. Feedback you voluntarily send may be used to improve the Service without an obligation to compensate you.
11. Suspension and termination
You may stop using the Service at any time. We may suspend or terminate access if you materially violate these Terms, create security or legal risk, abuse the Service, fail to pay applicable charges, or if we discontinue the Service. Where reasonable, we will consider the circumstances and applicable consumer rights. Terms that by their nature should survive termination will remain in effect.
12. Disclaimers
To the maximum extent permitted by law, the Service is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted operation, and error-free or completely secure access. We do not promise that using a VPN will make you anonymous, prevent every threat, or make otherwise unlawful activity lawful.
Some jurisdictions do not allow certain warranty exclusions. In those places, these exclusions apply only to the extent permitted by law.
13. Limitation of liability
To the maximum extent permitted by law, Sai VPN and its service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business interruption arising from the Service. Our total liability for claims relating to the Service will not exceed the amount you paid for Sai VPN during the 12 months before the event giving rise to the claim.
These limits do not exclude liability that cannot legally be limited, including mandatory consumer protections or liability for fraud, willful misconduct, or personal injury where applicable law says it cannot be excluded.
14. Changes to the Service or these Terms
We may update the Service and these Terms to reflect product, provider, security, or legal changes. The “Last updated” date identifies the current version. If a change materially affects your rights, we may provide additional notice where required. Continuing to use the Service after updated Terms take effect means you accept them, except where law requires a different form of consent.
15. General terms
Applicable laws govern these Terms without removing mandatory consumer rights you have where you live. Before starting a formal dispute, please contact us and give us a reasonable opportunity to resolve the issue. If any provision is found unenforceable, the remaining provisions stay in effect. A failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a reorganization or transfer of the Service, subject to applicable law.
